Conditions d’utilisation

1. Purpose and scope

These terms govern every sale made through this website by SounDeen ("we", "us") to a purchaser ("you"). Placing an order means you accept them in the version published on the day of the order. We sell to consumers and to businesses; some rights described below apply to consumers only.

2. Products

We sell magnetic Qur'an audio players and their accessories. Products are described and photographed as accurately as possible; slight variations in colour, grain and finish are normal for the materials used and are not defects. Battery life, playing time and range figures are typical values measured under normal use.

Some products are made to your specification — for example a player loaded with audio files you upload, or an item carrying artwork you choose. These are treated as personalised goods and are subject to specific rules set out in section 8 and in our Refund Policy.

3. Orders

An order is formed when you complete checkout and receive our order confirmation by email. We may refuse or cancel an order in case of an obvious pricing error, suspected fraud, an unpaid earlier order, or a delivery address we cannot serve. If we cancel a paid order, you are refunded in full without delay.

4. Prices

Prices are shown in the currency selected on the site. We do not charge VAT: VAT is not applicable under Article 293 B of the French General Tax Code, so the price you see is the price you pay, with no tax added at checkout. Delivery is charged in addition and is shown before you pay. For deliveries outside the European Union, import duties, taxes and clearance fees may be charged on arrival by the destination country; these are payable by you and are not included in our prices.

5. Discounts

Bundle discounts are applied automatically to qualifying players in the cart: −5% from two players, −10% from three. Discounts apply to the players themselves and not to accessories or add-ons. Automatic discounts and discount codes do not combine unless the site states otherwise. Free delivery and free gift thresholds are calculated on the basket total after discounts and before shipping.

6. Payment

Payment is taken in full at the time of the order through our payment providers. We never see or store your full card details. Your order is prepared once payment is authorised.

7. Delivery

Delivery times, costs and destinations are set out in our Shipping Policy, which forms part of these terms. Risk of loss passes to you on delivery. If you are a consumer and we fail to deliver within thirty days of the order, or by any later date we agreed, you may cancel the order after asking us in writing to deliver within a reasonable additional period.

8. Right of withdrawal

Consumers in the European Union have fourteen days from receipt to withdraw from the sale without giving a reason. The procedure, the deadlines and the legal exceptions — in particular for goods made to your specification or clearly personalised — are set out in full in our Refund Policy.

9. Legal guarantees

All our products carry the statutory guarantees, which apply free of charge and independently of any commercial warranty:

  • the legal guarantee of conformity (Articles L217-3 and following of the French Consumer Code), for two years from delivery;
  • the guarantee against hidden defects (Articles 1641 and following of the French Civil Code), for two years from discovery of the defect.

Under the guarantee of conformity you may ask for repair or replacement and, failing that, a price reduction or a refund. You do not have to prove the defect existed at delivery during the first two years. To make a claim, write to soundeen@gmail.com with your order number and a photograph or short video of the problem.

10. Content you upload

Where a product lets you upload audio files or artwork, you confirm that you own the rights to that content or hold the permissions needed to have it copied onto a device. You grant us a limited, non-exclusive licence to reproduce it for the sole purpose of manufacturing and delivering your order. We do not keep uploaded files beyond what is needed to fulfil and support the order, and we do not use them for any other purpose.

We may refuse, without refunding the personalisation work already carried out, any content that is unlawful, infringes a third party's rights, or is defamatory, hateful or obscene.

11. Liability

We are liable for the proper performance of the contract in accordance with applicable law. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be limited by law. Our products are consumer goods and are not medical, safety or professional equipment.

12. Events beyond our control

We are not liable for delays or failures caused by events outside our reasonable control, including carrier disruption, customs delays, natural events, and interruptions to power or telecommunications. We will tell you promptly and, if the delay is substantial, you may cancel the affected part of the order.

14. Governing law and disputes

These terms are governed by French law. As a consumer, you keep the protection of the mandatory rules of the country in which you live, and you may bring proceedings in the courts of that country. Before any legal action, please write to us so we can try to resolve the matter; you may also refer the dispute to a consumer ombudsman.

15. Changes

We may update these terms. The version that applies to your order is the one published when you placed it.
